These Terms and Conditions ("Terms") outline the rules for using the website mockupcloud.com (the "Site"). The Site is owned and operated by MB Mockupcloud ("Mockup Cloud," "we," "us").
Your use of this Site signifies that you have read, understood, and consented to be bound by these Terms at all times.
In this document, "you" or "user" refers to you as the user of the Site. "Party" may refer to either you or us, and "Parties" refers to both.
Please review these Terms carefully before you begin using the Site. By using the Site or creating an account, you accept and agree, on your own behalf or on behalf of your employer or another entity (if applicable), to be bound by these Terms and our Privacy Policy.

By using this Site, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. If you do not meet these requirements, you are prohibited from accessing or using the Site.

3. Purpose of Mockup Cloud
The Site operates as a curated marketplace for designers, where vendors (hereafter "Creators") publish and sell their digital products. Subject to these Terms, Mockup Cloud provides Site services to users and Creators, including hosting and maintaining the Site and making Creators' products available for viewing. The terms 'creator' and 'vendor' are used interchangeably.
4. User Accounts
To make a purchase and access products on our Site, you must first register and create an account.
Registration requires you to provide a first name, last name, and e-mail address.
When you create an account, you agree that all personal information you provide is up-to-date, accurate, and truthful, and you will update this information if it changes.
Your account will display your purchase history and provide access to download links and invoices.
We reserve the right to suspend or terminate your account if you use our Site for illegal purposes or if you violate these Terms.
In the event of a dispute over account ownership, we reserve the right to determine ownership based on our reasonable judgment.
5. Usernames and Passwords
Each person using the Site must register for their own account. During registration, you will be asked to select a username and password.
You are entirely responsible for safeguarding the confidentiality of your username and password. You agree not to share your credentials with any other person. If you are a legal entity, you agree to only share the credentials with an individual authorized to use your account.
You agree to notify us immediately if you suspect or become aware of any unauthorized use of your account or unauthorized access to your password.
You further agree not to use the account or log in with the credentials of another user or Creator if you are not authorized to do so, or if such use would breach these Terms.
6. Non-Permitted Usage
As a user or Creator, you agree to use our Site lawfully and not for illegal purposes. You agree not to:
- Violate the rights of other users or Creators of our Site.
- Violate the intellectual property rights of the Site owners or any third party.
- Hack into the account of another user or Creator.
- Act in any way that could be considered illegal or fraudulent.
If we believe you are using our Site illegally or in a manner that violates these Terms, we reserve the right to limit, suspend, or terminate your access. We also reserve the right to take any necessary legal steps to prevent you from accessing our Site.
7. Prices and Other Fees
Product prices (the "Fees") are determined at Mockup Cloud's sole discretion. Mockup Cloud reserves the right to change its Fees at any time.
All payments are in USD, unless otherwise stated in writing by Mockup Cloud.
Prices are valid only at the time of purchase and cannot be used as a reference for future purchases.
All listed prices are final. However, depending on your location, additional taxes or currency conversion fees may apply and will be calculated at checkout. If Mockup Cloud is obligated to collect or pay taxes for the Fees payable by you, such taxes may be added to your payment (regardless of whether they were collected on previous transactions) and will be reflected in the invoice. We recommend you verify any additional fees from third parties (such as international transaction fees or bank fees). Mockup Cloud is not responsible for any such additional costs.
By registering or submitting information, you authorize Mockup Cloud (directly or through third parties) to request and collect payment from your designated payment provider or bank account. This includes charging, refunding, or taking other billing actions, and making inquiries necessary to validate your payment account or financial information, including receiving updated payment details from your provider.
8. Purchases and Payments
To make a purchase, add the desired items to your cart and proceed to checkout, following the on-screen instructions.
You can pay your Fees via PayPal, Stripe, Credit Card, Debit Card, or any other payment method available at that time.
Purchasing a product may require you to provide information such as credit card details, billing address, name, company information, VAT number, and account information. By submitting this, you grant us the right to provide the information to third parties, subject to our Privacy Policy.
We are not liable for any direct or indirect losses you suffer from using third-party payment gateways.
If we believe your payment has violated any law or these Terms, we reserve the right to cancel or reverse your transaction.
You confirm that you have sufficient authority to bind the legal entity or business on whose behalf you are using the Site to make purchases.
Once an order is placed and payment is completed, it cannot be cancelled.
Before placing an order, please check all your information and purchase details. It is your responsibility to ensure these are correct.
After placing an order, you will receive a confirmation e-mail from us; this is our acceptance. Please check this e-mail and inform us if any information is incorrect.
If a product is unavailable or there is a pricing mistake, we will not process your order and will refund any monies already paid.
An agreement is only formed between Mockup Cloud and the user after the receipt of the confirmation e-mail.
We reserve the right to refuse any order placed through the Site at our sole discretion.
9. Terms for Creators
- Application: If you wish to become a Creator, please contact us (mockupcloud.com/contacts) with a short description and portfolio links. We evaluate product quality. If it meets our standards, you will receive an acceptance email. You will then complete an onboarding process, providing personal information, after which you can start selling products on our Site.

- Content Standards: Creator Content must not be illegal, threatening, obscene, racist, defamatory, libelous, pornographic, infringing on intellectual property rights, promoting illegal activity, invasive of privacy, purposefully false, or otherwise injurious or objectionable. It must not contain software viruses, commercial solicitation, chain letters, mass mailings, or "spam." Your Content should be unbiased and objective.
- Moderation: Mockup Cloud has the right to refuse or remove Content from the Site for any reason. Licenses issued for Content that is later removed will remain in full force.
- Identity: You may not use a false email, impersonate any person, or mislead as to the origin of Content. The name you provide may be displayed publicly. Mockup Cloud reserves the right (but has no obligation) to monitor, remove, or edit Content at its sole discretion, especially if it violates these Terms.
- License Grant: By submitting Creator Content, you grant Mockup Cloud a worldwide, nonexclusive, perpetual, irrevocable, and fully sublicensable right to index, analyze, use, modify, reproduce, adapt, translate, publish, create derivative works from, distribute, display, sell, advertise, market, and otherwise exploit such Content in any media. You waive any privacy, publicity, moral, or similar rights in favor of Mockup Cloud. You grant Mockup Cloud the non-exclusive right to license and use your Content.
- Marketing: You grant Mockup Cloud a worldwide, non-exclusive right to use your Content in connection with our marketing and promotional activities without compensation to you.
- Licensing to Users: Mockup Cloud shall have the right (but not the obligation) to license all Creator Content to its users for use in perpetuity, according to our license agreements.
- AI Disclosure: If artificial intelligence (AI) technology is used in creating or enhancing any product, this must be clearly stated in the product description. We value transparency. This rule builds trust and allows users to make informed decisions. Non-compliance may lead to product removal.
- Creator Warranties: You represent that you own or have the necessary permissions to use and authorize the use of your Content as described. You warrant that all Content you submit is accurate and that its use by Mockup Cloud and its users will not violate these Terms, cause injury, or infringe any third-party rights.
- Indemnification: You will indemnify, hold harmless, and (at Mockup Cloud’s request) defend Mockup Cloud, its affiliates, and representatives from all claims resulting from any Content you submit or any breach of these Terms.
- Liability: Mockup Cloud takes no responsibility and assumes no liability for any Content submitted by you or any third party, nor do we guarantee any confidentiality regarding Creator Content.
- Commissions: A base fee of 50% commission is deducted from the final selling price. An additional 15% of the product value is deducted per initial download by a Full Access Pass holder. For affiliate-referred orders, the affiliate receives 25%, and the remaining 75% is divided between Mockup Cloud and the Creator(s).
- Payment Calculation: Royalty payments are based on Fees actually received by Mockup Cloud, calculated after deductions for refunds, cancellations, overpayments, taxes, levies, duties, and currency exchange costs.
- Payouts: We provide payouts monthly (within the first 10 workdays) for your earnings from the previous month, via PayPal, unless otherwise agreed.
- Payout Threshold: If your total amount due is less than $100, the balance will be carried over to subsequent months until the minimum threshold is met or exceeded.
- KYC Verification: To receive payments, you may be asked to complete Know Your Customer (KYC) verification. This is handled manually, usually for suspicious activity or before a first payout.
- Required Information: First and last name (must match ID), author account email, and government-issued ID (verified via Stripe Identity).
- Data Storage: Mockup Cloud does not store ID documents; verification is handled by Stripe Identity. Only your first and last name are stored for compliance.
- Consequence: No KYC = No Payouts.
- Term Changes: Check the Site regularly, as we may change payout terms at our sole discretion. Changes apply to all transactions occurring after the change is published.
- Withholding Payments: Mockup Cloud reserves the right to withhold payment or use its right to set off in the event of a breach of these Terms.
- Your Responsibility: You are solely responsible for providing and maintaining accurate contact and payment information, including tax information. Payments may be suspended if your information is incorrect or payment fails for reasons attributable to you. We may withhold payments if we are required to obtain tax information and you do not provide it.
- Disputes: You must notify Mockup Cloud in writing of any payment dispute within thirty (30) days of such payment. Failure to do so results in a waiver of any claim relating to the disputed payment.
10. Prohibited Content
As a Creator, you agree not to publish, upload, or distribute any content that falls into these categories:
- Gambling: Content promoting or facilitating gambling, online casinos, betting, or lotteries.
- Pornography: Explicit sexual content in any media intended to cause sexual arousal.
- Violence: Content depicting or promoting violence, graphic harm, or brutality.
- Hate Speech: Content promoting hatred or discrimination based on race, religion, ethnic origin, sexual orientation, disability, or gender.
- Illicit Behavior: Content encouraging or instructing on illegal activities (e.g., controlled substances, hacking).
- Harassment and Bullying: Content targeting individuals or groups to harass, bully, or threaten.
- Extremism: Content promoting extremist ideologies or organizations.
- Self-Harm: Content encouraging or depicting self-harm or suicide.
- Other Objectionable Content: Any other content Mockup Cloud deems inappropriate, harmful, infringing on intellectual property, invasive of privacy, or misleading.
Enforcement: Mockup Cloud reserves the right to:
- Immediately remove any Prohibited Content without notice.
- Suspend or terminate the accounts of creators who repeatedly violate these guidelines.
11. Proprietary Restrictions and Intellectual Property
The Site, including its general layout, look and feel, design, information, content, source codes, databases, functionality, software, audio, video, text, photographs, and graphics, and the trademarks and logos ("Content") are protected by copyright, trademark, and other intellectual property laws.
Except as expressly provided in these Terms, no part of the Site and no Content, trademarks, or logos may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose, without our express prior written permission.
Access to products is limited to authorized users, who are granted a limited license to access, copy, and use the products (or print a copy of Content where applicable) in accordance with the applicable License Agreements on our Site. Please visit our Licenses page for detailed permitted uses.
Users have no right, and specifically agree not to do the following:
- Reverse assemble, decompile, reverse engineer, or otherwise attempt to derive the Site's source code, underlying ideas, or structure.
- Remove any copyright notice, identification, or other proprietary notice.
- Use automation software (bots), hacks, or any unauthorized third-party software designed to modify the Site.
- Attempt to gain unauthorized access to, interfere with, or disrupt the Site or its connected computer systems.
- Circumvent, remove, alter, or deactivate any technological measure or content protections.
- Use any robot, spider, crawler, or other automatic device or process to access, monitor, scrape, or copy information from the Site, or engage in any manual process for the same purpose.

- Use the Site in any manner that could damage, disable, overburden, or impair it, or interfere with any other user's enjoyment.

Users also agree not to permit or authorize anyone else to do any of the foregoing.
Mockup Cloud reserves the right, in its sole discretion, to refuse service, suspend or delete accounts, remove a Creator’s product, or deny access to accounts or products in the event of a material breach of these Terms or the applicable license agreement. After any suspension or termination, you may or may not be granted permission to use the Site or your account.
12. Access to Your Purchases
You will receive your download links via email after purchase and in the "Downloads Center" section of your account.
You can view your purchase history by logging into your account and navigating to the “Downloads Center,” which lists all previous purchases.
If you use, print, copy, or download any product in a manner that breaches these Terms, access to products may be temporarily or permanently suspended.
All purchases are non-transferable and are tied to the account that made the original transaction.
13. Promotions and Discount Codes
Any contests, sweepstakes, or other promotions ("Promotions") made available through our Site may be governed by rules separate from these Terms. If you participate in any Promotions, please review the applicable rules. If a Promotion's rules conflict with these Terms, the Promotion's rules will apply.
If a valid discount code applies to your purchase, you can apply it during checkout.
14. Refunds
As digital products are sold on our Site, we do not offer refunds once the products are downloaded. If you believe the product you purchased is faulty, please contact us within 30 days of your purchase. We may issue refunds or replace your product at our own discretion.
15. Feedback
Any reviews, suggestions, comments, or other feedback relating to our services ("Feedback") that a user provides, which is or may be subject to any Intellectual Property rights, shall be exclusively owned by Mockup Cloud.
By providing such Feedback, you acknowledge and agree that it may be used by Mockup Cloud to:
- Further develop, customize, and improve Mockup Cloud’s services.
- Provide ongoing assistance and technical support.
- Contact you with notices and/or interview requests based on your Feedback.
- Facilitate, sponsor, and offer certain promotions, and monitor performance.
- Create aggregated statistical data, which Mockup Cloud may use to provide and improve its services.
- Enhance Mockup Cloud data security and fraud prevention capabilities.
- Comply with any applicable laws and regulations.
You represent and warrant that your Feedback is accurate, complete, and does not infringe any third-party rights.
16. Disclaimer of Warranties
Your use of the Site, its content, and any services or items obtained through the Site is at your own risk. The Site, its content, and any services or items obtained through it are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, either express or implied.
Neither Mockup Cloud nor any person associated with Mockup Cloud makes any warranty or representation regarding the completeness, security, reliability, quality, accuracy, or availability of the Site or its contents.
Mockup Cloud does not warrant that your use of the products or services will be uninterrupted or error-free, or that Mockup Cloud reviews information or products for accuracy or quality. Mockup Cloud shall not be liable for delays, interruptions, service failures, or other problems inherent in the use of the internet, electronic communications, or other systems outside our reasonable control.
The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.
17. Limitation on Liability
In no event will Mockup Cloud, its licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use (or inability to use) the Site, any websites linked to it, any content on the Site, or any services or items obtained through the Site or from another user.
This includes any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of reputation, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
The foregoing does not affect any liability which cannot be excluded or limited under applicable law.
Although we make reasonable efforts to keep information on our Site up to date, we make no guarantees, representations, or warranties (whether express or implied) that the content on our Site is complete, accurate, or up-to-date.
Nothing in these Terms excludes our liability for death or personal injury arising from our own negligence, or our fraud or fraudulent misrepresentation, or any other liability that is not permitted to be excluded or limited by English law.
18. Indemnity
You will indemnify, defend, and hold harmless Mockup Cloud, and our respective directors, officers, employees, representatives, and agents from any and all claims, actions, damages, liabilities, costs, losses, and expenses (including attorneys’ fees) relating to or arising out of your use of the Site, your breach of these Terms, your violation of any third-party rights (including intellectual property rights), any review you post, or arising out of a contractual relationship with another user.
19. Consumer Protection Law
These Terms do not in any way exclude or limit your consumer rights and remedies under the Consumer Rights Act 2015.
20. Relationship with Mockup Cloud
Nothing in these Terms is intended to, or shall be deemed to, establish any partnership or joint venture between any of the Parties, constitute either Party the agent of the other, or authorize either Party to make or enter into any commitments for or on behalf of the other Party.
21. Links to Other Websites
Our Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked on our Site. It is your responsibility to read the terms and privacy policies of these third-party websites before using them.
22. Severability
If at any time any provision of these Terms is found to be inconsistent or invalid under applicable laws, that provision will be deemed void and removed. All other provisions will not be affected by the removal, and the rest of these Terms will still be considered valid.
23. Interpretation
Headings are inserted for the convenience of the parties only and are not to be considered when interpreting the Terms. Words imparting the singular number shall include the plural and vice versa. References to communications include e-mails and posts.
24. Force Majeure
Neither Mockup Cloud nor the users are liable for any failure or delay in performing their obligations where such failure or delay results from any cause beyond the reasonable control of that Party; unless the Party was aware of, or it was reasonably foreseeable that such a cause might occur in the future in such an extent that it might affect the performance the parties’ obligations. Such causes include, but are not limited to, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, global or regional pandemics, governmental action, or any other event that is beyond the control of the Party in question. If the delay continues for a period of 90 days, either of the parties may terminate or cancel the services to be carried out under these Terms and Conditions.
25. Waiver
The waiver by either Party of a breach, default, delay, or omission of any provision of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.
26. Assignment
The rights granted and obligations undertaken hereunder may not be transferred, assigned, or delegated by users or Creators without prior authorization from Mockup Cloud. However, they may be freely transferred, assigned, or delegated by Mockup Cloud.
27. Changes
We reserve the right to amend these Terms from time to time to maintain compliance with the law or to reflect any changes to the way we expect users to behave on our Site. Changes to these Terms only take effect after they have been published in an appropriate manner on the Site.
